1. OnLine Selling

The selling general conditions are applied on sales executed on the web site www.italytourism.it , this conditions regulate the methods of reservation, payment, annulment of the hotel services and links such as (transfer, tour etc) when applied towards the client which has already reserved such services.
Regarding the selling of tourist packages the relative norms are applied in conformity with the 111 legislative decree on date 17/03/95 of fulfilment EEC directives n.90/14 for consumer protection.
These regulations will be applied when at least two of the following elements should be reserved, sold or offered at a prefixed price at a 24 hour superior lasting

  • Transportation
  • Acommodation
  • Tourist services not regarding transportation or acommodation which may be important for the tourist package
  • 2. Tourist and Hotel Services

    The quality of the given services, hotel information,  published prices, booking conditions, annulments, ways of payment and any possible changes are published in the brochure of each hotel on the web site www.italytourism.it
    In order to assume the responsibility and the transparency of the precepts as well as the quality of the tourist services offered to the consumers, it is necessary to enhance that the content of each one of the brochures  has been precisely  approved  by the hotelkeeper prior to their publicizing.
    The sell prices published on the web site are given by the hotel in conformity with its own seasonal criteria, that is why such prices could be modified because of promotional offers, last-minute offers or thematic packages during the year.
    Sell prices are given per person per night. Sometimes these prices  include meal supplement. Possible supplements such as: double rooms for single use, extra beds or boards will be added during the booking and calculated automatically by the system.

    The hotelkeeper is responsible for the quality of the given services and hotel  information published on the web site.

    If any objections appear regarding the quality of the given services and the hotel information, the client must immediately inform the hotelkeeper as well as Foursprings srl , in order to find the best way to solve the problem, looking for alternatives to reduce possible damage.

    Such objections are accepted form by the hotel in written form, sent to Foursprings legal address ( see below).

    3. Reservation system

    Sales carried out through the online reservation system and managed by  Foursprings srl OPERATOR with :
    Main office in Milano in milan viale bligny 54 Tel. +39 02 49 79 04 51  fax  +39 02 700 49 528 license n. 2799/99 Provincia di Milano (Insurance: Navale Assicurazioni Milano).

    Foursprings sells the tourist products through the on-line reservation system - FourSprings MULTIBOOKING SYSTEM which gives the client possibility:
    - to estimate booking without any registration in Foursprings system;
    - have access to client’s personall area;
    - make different kinds of booking;
    - confirm created booking;
    - modify the booking;
    - cancell the booking .

    4. Booking estimation

    Foursprings  MULTIBOOKING SYSTEM gives the client a possibility to estimate the booking before saving without any payment or possible penalty charges and without registration in Foursprings system.

    5. Registration and personal area access

    The client is able to Access the on- line reservation system having taken the process of registration. After that, using the User-name and password client can enter the system, where different  reservations can be made.
    With User-name and password it is also possible to:
    -  save previously evaluated booking in the client's account area of the FourSprings MULTIBOOKING SYSTEM.
    -  to have access a reserved area in order to view in the real time all the information about all existing reservations ( open/closed bookings, saved and to be confirmed, made on request).

    6. Booking possibilities

    Clicking on the button 'Action' the client can make:
    Instant Booking- booking of the available products. In the case of booking annulment all applicable penalty charges (if exist) are surcharged from the client immediately from the moment of the booking. Purchased product is guaranteed.
    Booking on- request works in case the client wants to find out the information about product availability- the TO confirm the booking within 24 hours (all applicable penalty charges (if exist) will be surcharged in the case of booking annulment only in the case of client's reconfirmation of the booking)
    Promise Booking works in case the client is sure to buy the product without reference to availability- the client guarantees payment for requested product (the requested product will be confirmed to the client and in the case of booking annulment all applicable penalty charges (if exist) will be surcharged)

    7. Booking Confirmation

    The client's legal obligations start when he clicks on the yellow button 'Confirm' (in case of Instant booking, in case if the service/product is available in Promise booking and in case of the reconfirmation of the booking on request).
    Reservations may be confirmed when the system shows full disponibility for the kind of services required, possible supplements, number of beds.
    The client's confirmation of the booking or sending of a request to the product/service supplier is effected via electronic mailing system. The procedure of the mailing system between the client and the service/product supplier is described in llg Travel mailing scheme. 
    After the booking e-mail confirmation is received, the client must pay 30% for all ordered products and give all needed documents.

    8. Booking Modification

    The client has the possibility to modify the reservation within 10 days prior to the arrival with a new reservation at the same hotel making online verification, in order to know the availability and the possibility to use the same deposit.

    9. Booking cancellation

    In case of cancellation of the booking, fourspsrings refunds the sum to the client paid in advance minus penality amounting at 25 euro for each  client for administrative expences.
    In case of cancellation or termination of the present Contract, Foursprings  is obliged to return the balance to the client in the period of 30 days from the date of remitting the money.
    A Voucher printout of the booking confirmation with the booking reference number is necessary in order to receive the requested tourist products.

    10. Payment and penalty clause

    The ways of prepayments are shown automatically at the moment of the reservation.

    The reservation can be paid by credit card or, in some case, by bank transfer.

    The reservation is held for 24 hours in order to signify acceptance by making payment in full. Payment failure within 48 hours after the booking confirmation for accommodation, not available for immediate confirmation, leads to the automatic cancellation of the booking.

    If the sum is not paid within 48 hours, the Foursprings may proceed to cancel the reservation, except for the Penalty Clause applicable to each reservation.

    In any case, payment must be made in Euro before the beginning of  the trip, if other conditions are not mentioned in addition.

    11. Security system for credit card payment

    The client can pay all sums to the Foursprings in EURO, using a credit card at the time when the reservation is confirmed by the Foursprings .
    All online transactions are carried out by the Banca  Intesa (SETEFI) electronic payment systems, which are certificated 'Verysigned' and protected by the SSL3 128 bit protocol system.
    Once the transaction is completed, the Foursprings company sends the Agency a notice of payment received, and also the residual amount to be paid to the product provider.
    The Foursprings does not have any access to the client's credit card data due to the fact that the use of this information for the payment of bookings is carried out on a bank-protected server, in accordance with the highest international security standards. This server that contains and protects the credit card data is property of Bank and is not accessible to third parties.

    12. Privacy regulation

    Your personal data is handled by computerized and manual  procedures.

    The type of personal information that we store in our system include: name, address, e-mail address, telephone number, fax number.

    We may use the information you provide about yourself to fulfil your requests for our products or services that you are interested in.

    To protect your privacy and security we take reasonable steps to help verify your identity before granting access or making corrections.

    The owner of such data and the undersigned Foursprings  s.r.l with main office in Viale Bligny 54  Milano could execute the rights sanctioned by  art. 13 of law summarized as follows:
    -be partially or totally against the handling of the data
    -ask for the correction or annulment of the data
    -be partially or totally against the handling of personal data for business or advertising purposes, for direct selling or market research.

    13. Arbitral clause
    The contract between the c and the client is regulated by the Italian law regarding tourism, which includes the laws of the European Community if applicable to the sales of tourist products.
    For any objection other than those already mentioned, Foursprings undertakes the responsibility of solving any controversy in a preliminary and affable manner, if the controversy in question was immediately communicated by fax or e- mail to our reservation centre within 10 working days from the date of the client's departure to the country of tour.

    If more than 10 working days have passed from the date of the client's departure to the country of tour and the controversy has not been solved, the client may ask for arbitration in presence of a justice of the peace of the Milan court. The ruling will be in conformity to his authority.

    For problems that are out of the jurisdiction of a justice of the peace, controversies are submitted to a sole arbitrator nominated by the national and international business chamber of Milan. Such arbitrator decides a controversy in an informal way within 90 days from the nomination date.

    The arbitration award will be binding between the client and Foursprings and immediately executive.

    All the communication between the parts with regard to complaints about services and the arbitral clause according to the present contract must be made by registered letter or fax to both addresses.
